1. Who We Are

Undersoul is an AI-guided shadow work journal designed for self-reflection. We are a software product, not a healthcare provider. See our Therapeutic Disclaimer for important context before using the app.

2. Accepting These Terms

By creating an account, checking the consent boxes during signup, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Disclaimer, and our Refund Policy.

3. Eligibility & Accounts

You must be 18 years or older to create an account on your own. Users aged 13–17 may use Undersoul only with verifiable consent from a parent or legal guardian who agrees to these Terms on their behalf. We do not knowingly collect any information from anyone under 13.

When you create an account, you agree to:

• Provide accurate, current information (including a real email address).
• Maintain one account per person.
• Keep your password confidential and not share your account.
• Be responsible for everything that happens under your account.
• Notify us promptly at legal@undersoul.app if you suspect unauthorized access.

4. Your License to Use Undersoul

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own self-reflection. You may not sublicense, resell, or commercially exploit any part of the Service.

5. Subscription, Free Trial, and Billing

Undersoul offers a 7-day free trial with full access to most features. A small set of features (such as Deepen Your Profile) require an active paid subscription.

A valid payment method is required to start your free trial. If you don't cancel before the trial ends, your subscription will automatically renew and you will be charged at the standard rate:

• Monthly: $14.97 / month
• Annual: $89.97 / year

Subscriptions auto-renew at the end of each billing period at the then-current rate, unless you cancel beforehand. Prices may change with notice — we'll let you know before any change applies to your renewal.

5.1 Cancelling Your Subscription

You can cancel at any time:

• iOS (App Store): Settings → Apple ID → Subscriptions → Undersoul → Cancel Subscription.
• Web: Account Settings → Manage Subscription → Cancel.

Cancellation takes effect at the end of your current billing period — you keep access until then. No partial-period refunds. See our Refund Policy for details.

5.2 Apple App Store Purchases

If you subscribe through the Apple App Store, payment is charged to your Apple ID account. Apple, not Undersoul, manages billing, renewals, and refund requests for App Store purchases. You can request a refund via reportaproblem.apple.com.

6. Your Content

Everything you write or record in Undersoul — journal entries, session responses, voice memos, assessment answers — is yours. You own your content.

To run the Service, you grant us a limited license to store, encrypt, transmit, and process your content solely so we can show it back to you and generate AI reflections you request. We do not use your journal entries to train AI models. We do not sell, rent, or advertise against your content. Ever.

You can export or delete your content at any time. When you delete your account, we delete your content within 30 days, except where we're legally required to retain certain records.

7. AI Processing

Undersoul uses Anthropic's Claude API to generate reflections, prompts, and analysis based on what you write. By using AI-powered features, you understand that:

• Your text is sent to Anthropic to generate a response.
• Per Anthropic's API terms, your content is not used to train their models.
• AI output may be incomplete, inaccurate, or miss important context — treat it as a starting point for reflection, not professional advice.
• AI responses are never a substitute for guidance from a licensed mental health professional.

8. Prohibited Uses

You agree not to:

• Harass, threaten, or harm any person, including via content you submit.
• Scrape, crawl, or mass-extract data from the Service.
• Reverse-engineer, decompile, or attempt to extract our source code or AI prompts.
• Use the Service to generate content that exploits, harms, or sexualizes minors.
• Use AI output to harm, deceive, or manipulate others.
• Make medical, psychiatric, or safety decisions based on AI output.
• Resell, sublicense, or commercially exploit the Service.
• Bypass any access controls, rate limits, or security measures.
• Use the Service to violate any law or third-party right.

9. Account Termination

You can delete your account at any time from Account Settings. When you do, your data is removed from active systems and fully deleted within 30 days.

We can suspend or terminate your access if you violate these Terms, abuse the Service, or if we're legally required to. If we terminate your account for cause, you won't receive a refund for the remainder of your billing period.

10. Disclaimers

Undersoul is a self-reflection journaling tool — not a healthcare service. We do not diagnose, treat, cure, or prevent any condition. See the Therapeutic Disclaimer for the full statement.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, UNDERSOUL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claim arising from or relating to the Service is capped at the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $50.

12. Indemnification

You agree to defend, indemnify, and hold harmless Undersoul, its affiliates, and personnel from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from your misuse of the Service, violation of these Terms, violation of any law, or infringement of any third-party right.

13. Dispute Resolution & Arbitration

Please read this section carefully. It affects your legal rights.

Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Delaware, USA, or by remote hearing where available.

You and Undersoul waive any right to a jury trial and waive any right to participate in a class action, class arbitration, or representative proceeding. Claims must be brought individually.

Notwithstanding the above, either party may bring an individual action in small-claims court, and either party may seek injunctive relief to protect intellectual property rights.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Where arbitration does not apply, exclusive jurisdiction lies with the state and federal courts located in Delaware.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll notify you by email or in-app notice before the changes take effect. Your continued use of the Service after the effective date means you accept the updated Terms. If you don't agree, please stop using Undersoul and delete your account.

16. Miscellaneous

These Terms are the entire agreement between you and Undersoul regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a right is not a waiver of that right. You may not assign these Terms; we may.
